Subject: Demand for Refund of Security Deposit and Compensation for Misbehaviour 

Under instructions and authority from my client Mr. Rajeev Saran Singh. R/O House No. 335, East Champaran, Bihar (845414) (hereinafter referred to as “my client”), Postal Address, House No 1199, (Near Bus Stand), Uttam Nagar, New Delhi-110059.

This legal notice serves as a formal demand for the immediate return of advance deposit unlawfully withheld by you for flat rent and compensation for the unprofessional and intimidating behavior encountered by my clients.

On, 06-05-2024. You and My client had a conversation for rent of your flat House No 1199, (Near Bus Stand), Uttam Nagar, New Delhi-110059. 

  1. That, You agreed on a rent of 8000/- (Eight Thousand Only) per month i.e. without electricity bill and water bill.
  2. That, You had mentioned that the rent would be 8000/- (Eight Thousand Only) per month and one month’s rent in advance as security money, totaling 16000 (Sixteen Thousand Only).
  3. That, You promised my client that once he moves into the flat, then you would make the payment and sign the agreement.

  4. That, my client saw your flat at 8 PM that night and he liked it. However, he mentioned that you should get it repaired and also have it painted and only in that condition he will take it on rent, for which you agreed.

  5. That, You also said that “you will need to give an advance of 5000, and the full amount after moving in.”
  6. That, my client gave you an advance of 5000 on May 6. Through your UPI id (Transaction id- )
  7. That, The next day, my client spoke to you about getting the flat cleaned and painted.
  8. That, You contacted my client on the next day, (On May 7, 2024,) at 8 PM and called him to come the flat.
  9. That, When my client went to the flat and saw that you had not done the cleaning or Painting.
  10. That, You told my client to give an additional 5000, and you would start the work from tomorrow.
  11. That, my client gave you Rs. 5000 (Five Thousand only) in cash in the presence of my friend Kamal Kumar Singh and said to start the painting and cleaning from tomorrow.
  12. That, When my client went to the flat at 12 PM on 08-05-2024, neither cleaning nor painting had been done.
  13. That, my client called you and asked about it, and you said that you would get the cleaning done but not the painting.
  14. That, You also said that my client would have to live with it as it is, and you started asking for the remaining money.
  15. That, as per the initial conversation my client asked for the refund as you miscomitted of getting it painted and didn’t do it, to which you denied to refund.
  16. That, Initially you refused to return the advance but after much requesting of my client, you agreed to return 1000 but refused to return full amount.
  17. That, You spoke very rudely to my client and hurt their sentiments which caused my cient unwarranted mental agony.
     
  18. That, You returned 1000 and clearly refused to give back the rest of the money and displayed unprofessional behavior including:
  • Denying the refund outright. You initially denied it and later only refunded Rs. 1,000 while refusing to refund the remaining amount. you also threatened to take back the refunded money.
  • Retaining a significant portion of the deposit (Rs. 9,000) after repeated requests, without any valid justification.
  • Refusing to return calls and engaging in disrespectful and misbehaving communication.

These actions caused significant distress and anxiety to my client, particularly considering their student status and limited financial resources.

Hence, In the light of the aforementioned facts and unacceptable behavior, I request the following from your establishment:

  1. Immediate and full refund of the deposit of Rs. 9,000.
  2. Written apology acknowledging the unlawful withholding of funds and unprofessional conduct.
  3. Compensation of Rs.45000/- for the mental stress and inconvenience caused to my clients.

Failure to comply with these demands within 15 days of receipt of this notice will leave my clients with no choice but to pursue legal action against your establishment, including:

  • Filing a case with the District Consumer Disputes Redressal Forum.
  • Initiating criminal proceedings for unlawful withholding of funds and intimidation.

Through this notice, I am extending final opportunity and communication to resolve it amicabily by returning the amount taken through miscommitment.

Please note that this notice is without prejudice to any other rights or remedies available to my clients under the law.

A copy of this legal notice has been retained and kept in record for legal proceedings/action, if any, required in this matter.
