A bailable warrant is when an accused does not appear before the court of law on repetitive requests by the court of law. In order to procure the presence of the accused the court first issues a bailable warrant.
If you fail to appear in court due to any personal reason and forgot court’s date and also your counsel do not submit exemption application and your counsel too doesn’t appearin the listed matter, Court will issue bailable Warrant against accused/witness to produce him in court..
Bailable warrant means Zamanti Warrant, here magistrate gives power to Police Officer to go to their residence and inform them regarding the warrant and they have to appear on next date of hearing .
Must check : Court stamp plus Hon’ble Judge’s signature. If anyone is missing that warrant might be fake.
Now, how to get it cancelled?
A. Police Officer will come at the residence and inform that as you were not present on last date of hearing, bailable warrant has been issued
B. No need to panic here , because police officer has been just given direction to inform you.
C. Once police officer reached at your home, you need to fill bail bond with one surety , police will return back after informing you the next date of hearing
D. Appear on next date of hearing and approach the concerned court through your advocate and make an application for cancellation of warrant stating the reasons why you could not appear before the court and give an undertaking that you will remain present in future.
E. Bailable warrant will be recall once you appear on Next date of hearing. Magistrate will cancel the warrant
