SUBJECT: Legal Notice For Non Payment of Salary
- That You the Noticee, appointed my client and Labour Mr. Roop Kumar, Shamsher Singh and Sanjay Kumar on DD-MM-YYYY for Ply Shuttering (In Roof) Work.
- That my client is a very hardworking employee and did his duty diligently, and with utmost punctuality and sincerity. My client was fully devoted to his duty.
- That You, the Noticee had terminated him without any reasonable reasons or in a totally illegal way.
- That You, the Noticee had not even fulfilled the conditions as per the contract.
- That You the Noticee, did not pay the wages of my client which amounts to Rs. 21,000.
- That my client visited your place from time to time for payment and even called you many times but You, the Noticee refused to pay.
- That you the Noticee, is unnecessarily harassing my client by not paying wages, and the same is a punishable offence under Section 21 of the Contract labour (Regulation and Abolition) Act of 1970. My client is totally disturbed by your behavior.
- Also, by not paying the wages of my client, you shall be held liable under the payment of wages act, 1936 which ensures that workers get timely payment of wages.
- Also, my client has been intimidated by you (the noticee) and informed that he will not get any dues and he can do whatever he wants to do, which is a direct threat and makes you liable to be tried under section 503 and 506 of Indian Penal Code.
I, therefore, call you through this Notice, to make the payment of the Rs. 21,000/- to my client along with 18% interest, within the period of 15 days, failing which my client has given clear instructions to take appropriate legal action against you in the competent court of law and in that event, you will be fully responsible for all costs, risks, responsibilities, expenses, and consequences thereof. Please note well.
Please note that a copy of this Notice has been preserved in my office for record and future course of action.
