SUBJECT: Notice for Dissolution of Marriage through Mutual Divorce under section 13B of Hindu Marriage Act.

Under the instruction of my client Ms. Rashi Saraswat, D/O Mr. Rajendra Saraswat R/O Lakshmi Nagar, New Delhi – 110050 (hereinafter referred to as “my client”) I would like to address you as follows:-

  1. That my client is a law abiding citizen of India and is residing at the above- mentioned address.
  2. That my client got married to you on 5th of June 2015 according to Hindu rites and Customs in the presence of friends, relatives and family members of both the parties.
  3. That after the marriage you and my client lived together as husband and wife and cohabited with each other at Saraswat Enclave, New Delhi – 110047
  4. That my client performed all her duties and obligations towards you as a wife.
  5. That there was no mutual love, care, respect, support; which in general most newly wedded brides expect.
  6. That my client did not get any kind of support and inclusivity in the family from You.
  7. That After marriage, my client got to know that you were involved in antisocial activities and you were addicted to alcohol. You started adopting cruelties mentally as well as physically upon my client and whenever my client tried to mend your ways, you started abusing and torturing her.
  1. That my client has not received any financial support till date from your side.
  2. That your attitude towards my client was very rude and indifferent from the very beginning of the matrimonial relations and my client always fulfilled your illegal demands from time to time.
  3. That my client after repetitive efforts have been made to be bound to send this formal communication as a final reminder to consider her requests mentioned thereinafter.
  4. That, after going through all the mental and physical torture at your hands, which is an offence under The Protection of Women from Domestic Violence Act, 2005, my client is hereby refraining from taking any legal action against you keeping in mind about the well being of the families involved and hereby officially informing and providing you an opportunity to take divorce mutually and end the sufferings once and for all.
  1. That is due to all the differences mentioned above. My client wants to dissolve her marriage immediately.

I, therefore, call upon you through this legal notice to execute the Divorce Under Mutual Consent under section 13(B) which will be signed both by you and my Client.  My Client  is dissolving this marriage immediately within a period of 30 days from the date of receipt of this instant legal notice, failing which my client shall be at liberty to file appropriate proceedings against you in the court of law and in that event you shall be responsible for all costs, risks and responsibilities which may be noted.

A copy of this notice has been preserved at my office for record and future course of actions.
