What Is Superdari Application?

Superdari Application also known as “Supurdgi Application” or “Supurdari Application” is a legal request made to the magistrate for the release of the seized items or property. When Goods, documents, vehicle, property etc are seized by the police during an investigation, the rightful owner often needs an early release of the seized items to avoid inconvenience. This specific remedy is called Supardari application.

Legal Basis of Superdari Application

Section 451 CrPC | Section 497 BNSS

Section 451 under CrPC and Section 497 under BNSS empowers the magistrate to:

Order the custody, disposal or delivery of the seized property in the pending trial.
Prevent the property from deteriorating or being permanently damaged.
Ensure the property remains available for evidence in court.

When is Superdari Application Needed?

One may need to file the Superdari Application in cases like :

Your vehicle is seized in accident, insurance related cases or document verification case.
Goods are seized by police during the raid.
Documents such as RC, License, Registration or invoice is taken into custody.
Your Laptop, mobile phone or business equipment is held as evidence.
Animals or perishable items seized need immediate return to avoid harm.

Who Can File a Superdari Application

A Superdari application can be filed by:

The owner of the seized property.
A person having legal interest in the property.
A person who can prove possession or entitlement.

APPLICATION ON BEHALF OF MR. PAWAN S/O SH. SURENDRA SHARMA R/O HOUSE NO.30, AWAS VIKAS COLONY, VILLAGE MANDAWLI, DELHI-110042 FOR RELEASE THE R.C. & NATIONAL PERMIT OF THE VEHICLE BEARING NO.DL-2GW-9898 ON SUPERDARI.

It is submitted as under:-

That the above said vehicle is impounded by the police officials of P.S. ASHOK NAGAR, DELHI in the above mentioned FIR bearing no.169/2018.
That the applicant is the registered owner of the above said vehicle bearing no. DL-2GW-9898 which was released earlier on superdari, but the above said documents i.e. R.C. & national permit of the abvoe said vhicle was detained by this Hon’ble court in court file.
That the investigation with regard to the above mentioned vehicle has already been completed and it is no more required by the concerned court.
That the above siad documents is no longer required by the police for any purpose.
That the applicant abide by all the terms and condition imposed by this Hon’ble court, if the said documents is released to the applicant on superdari.

It is, therefore, most respectfully prayed that this Hon’ble court may kindly be pleased to release the above said documents, in the interest of justice.
